Eligibility: The Bicycle Cards Euchre Tournament (“Contest”) begins on March 20, 2023, at 5:30 PM Eastern Standard Time (“EST”) and ends on March 20, 2023, at 8:30 PM EST (the “Contest Period”). The time shall be determined by Sponsor’s timekeeping systems, and Sponsor may also rely on the time processing functions of third parties. Sponsor shall have the sole discretion in determining the timeliness of any action or inaction related to this Contest.

Open to legal residents of the 50 United States, Washington D.C., and United States Territories who are 18 years of age or older, are current students enrolled at least half-time in an accredited undergraduate/graduate post-secondary institution, and have a valid student ID card issued from that institution. The ID card must be current and contain the entrant’s photo. Employees of the United States Playing Card Company (“Sponsor”) or any of its affiliates and members of their immediate families, and those with whom they reside, are not eligible to participate. “Immediate family” means spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or those living in the same household. Promotions are subject to all applicable federal, state, and local laws.

To Enter: You may enter the Contest by completing and submitting the entry form provided on the Bicycle Playing Cards Euchre Tournament Eventbrite page or Facebook event page and follow all other details specified on the Eventbrite or Facebook event pages. Sponsor is not responsible for lost, late, misdirected or otherwise unreceived Entries or Entries not received regardless of cause.

By entering and/or participating, entrants agree to be bound by these Official Rules and agrees that the Sponsor may contact the entrant using the email address, phone number, or other contact information provided with the entry, to administer and fulfill this Contest. Any Entrant’s failure or inability to receive any message(s) from Sponsor for any reason shall be deemed a failure by such entrant to comply with these rules, such entrant shall be disqualified from the Contest.

By entering, you will and hereby grant to Sponsor a perpetual, irrevocable, exclusive, worldwide, royalty-free, sub-licensable, freely assignable license to reproduce your Entry and to otherwise use, exploit, copy, modify, adapt, edit, publish and display the Entry in any form, manner, venue, media or technology now known or later developed for any and all purposes, including, without limitation, for purposes of commercial or trade purposes, advertising, and promotion as Sponsor and its licensees or assignees determine, without further compensation, notification, or permission. Further, by entering, you hereby waive any moral rights you may have in any Entry in favor of the Sponsor.

By entering the Contest you grant to Sponsor and its affiliates, licensees, assigns and successors the absolute and irrevocable right and permission to use, re-use, publish, re-publish, display, perform, transmit, exhibit, and reproduce your name, statements, video, voice, photograph, or other likeness (“Likeness”) in connection with the Contest in all forms and media including composite or modified representations for all purposes, including advertising, trade, or any commercial purpose throughout the world and in perpetuity.

By entering the Contest premises, you waive and release Sponsor and its affiliates, licensees, assigns and successors from any claims that may arise regarding the use of your Likeness in connection with the Event, including, without limitation, any right to inspect your Likeness, any claims for invasion of privacy, violation of the right of publicity, defamation, infringement of moral rights, and copyright infringement or for any fees for use of your Likeness.

Winner Selection: Entrants will be required to keep track of their score and wins/losses for each euchre game played, and calculate their total points scored and wins at the end of the Contest. The winner will be the entrant with the highest point total at the end of the Contest. If multiple entrants have the same total score, the total number of games won will be the tiebreaker used to select the winner. If multiple entrants have the same total score, and number of games won, the prizes will be evenly split amongst the winners.

Prizes: $1,000 from Sponsor to be used towards school expenses awarded in the form of a check and paid directly to the winner’s university or to be issued in the winner’s name within two (2) weeks following receipt of the Affidavit of Eligibility and Liability and Publicity Release by Sponsor.

Scholarship Prizes are to be used solely toward the required tuition, fees, books or supplies in connection with the enrollment of the winner at an educational institution that meets the requirements set forth in Section 117 of the Internal Revenue Code and the regulations thereunder. Prizes are not subject to Federal Income Tax if used in accordance with the requirements of Section 117 of the Internal Revenue Code. All federal, state and local taxes are the sole responsibility of winner. No substitution or transfer of prize permitted except that the Sponsor reserves the right to substitute a prize for one of equal or greater value, in its sole discretion. A 1099 tax statement will be filed with the IRS for the value of the Prize. All winners that receive a Prize will receive a 1099 form in the mail, to be processed in the tax year in which their prize is received.

Prizes are subject to verification of eligibility and compliance with these Official Rules. AN ENTRANT IS NOT A WINNER UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF ENTRANT’S ELIGIBILITY AND ENTRANT COMPLIES WITH THESE OFFICIAL RULES AND ANY OTHER APPLICABLE RULES.

PRIVACY: Entry information collected by Sponsor is the property of Sponsor, will be used according to Sponsor’s Privacy Policy, Facebook’s Privacy Policy, and will not be used for any purpose other than administering the Contest.

NO LIABILITY & INDEMNIFICATION: By entering this Contest, you agree to release, discharge and hold harmless Sponsor and their respective directors, officers, employees, agents and assigns (the “Released Parties”) from any claims, losses, and damages arising out of, or relating to, your Entry, your participation in this Contest or any Contest-related activities, and the acceptance and use, misuse, or possession of any prize awarded hereunder (including, without limitation, any misrepresentation made by you in connection with the Contest; any non-compliance by you with these Official Rules; claims brought by persons or entities other than the parties to these Official Rules arising from or related to your involvement with the Contest; acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; any malfunction, error or other problem arising in connection with the collection, processing, or retention of Entry information; or any typographical or other error in the printing, offering or announcement of any winner. The foregoing includes, without limitation, any claim for personal injury, property loss or damage, or death arising in any way in connection with the Contest.

If Sponsor’s use of your Entry or your participation in the Contest causes Sponsor to be subject to a claim by any third party (including, but not limited to, a claim of infringement), you agree to indemnify and hold harmless the Released Parties, and all persons acting by, through, under, or in concert with them, against any and all damages, costs, judgments and expenses (including reasonable attorney’s fees) which the Released Parties (or any one of them) may incur as a result of the use of your Entry.

Limitations of Liability. BY PARTICIPATING IN THE CONTEST, PARTICIPANTS ACKNOWLEDGE AND AGREE THAT EVERYTHING REGARDING THIS CONTEST, INCLUDING THE PRIZE(S) AND ANY WEBSITE(S), ARE PROVIDED “AS IS” AND THAT SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE PRIZE(S) OR ANY WEBSITE(S), AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE RELEASED PARTIES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.)

THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (1) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PARTICIPANTS, PRINTING OR PRODUCTION ERRORS, OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR EMPLOYED IN THE CONTEST; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN NETWORK HARDWARE OR SOFTWARE; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE CONTEST; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE CONTEST, THE PROCESSING OF ENTRIES, OR THE NOTIFICATION OF ANY WINNER; OR (5) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM A PARTICIPANT’S PARTICIPATION IN THE CONTEST OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.

Only the prizes stated in these Official Rules are available to be won in the Contest. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award prizes based upon random selection.

OTHER TERMS: Decisions of Sponsor on all matters related to the Contest are final and binding. Sponsor reserves the right to cancel or modify the Contest for any reason, including but not limited to, in the event the Contest is compromised by a virus, non-authorized human intervention, tampering, public health crisis, governmental action, or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness, integrity or proper operation of the Contest as determined by Sponsor, in its sole discretion. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsor.

Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, if the individual fails to comply with any requirement of participation or with any provision in these Official Rules, if the individual’s behavior or communication at any point is disruptive, may or does cause damage or to any person, property, or reputation of Sponsor, or is otherwise not in accordance with all applicable laws and generally accepted social practices as determined in Sponsor’s sole discretion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY APPLICABLE LAW.

CONSTRUCTION and GOVERNING LAW: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.Any disputes arising under this Contest and/or these Official Rules will be governed by relevant U.S. federal statutes and regulations and the internal laws of the State of Delaware.

ARBITRATION: Sponsor and each entrant agree that any such claim or dispute between the parties, or between a party and any agent, employee, successor, or assign of the other, related to this Contest and/or these Official Rules (including the applicability of this arbitration clause) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by this Section. (The AAA Rules are available at adr.org or by calling the AAA at +1-800-778-7879.) The United States Federal Arbitration Act will govern the interpretation and enforcement of this Section. The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or these Official Rules are void, voidable or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.

YOU WILL NOT BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER PERSONS OR ENTITIES IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.

ANY CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THE CONTEST OR THESE OFFICIAL RULES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES; OTHERWISE, SUCH CLAIM IS PERMANENTLY BARRED.

SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

NO AFFILIATION: This Contest is in no way sponsored, endorsed or administered by, or associated with any college, university, or Facebook. Any questions, comments or complaints regarding the Contest should be directed to Sponsor.
